Gambling Native American Style

The ethnic identity of most Americans would seem to be a fairly straight forward conclusion from an outsider’s point of view. However, there is more to it than meets the casual eye. Every few years, a national census is carried out to determine the national population and learn more about the people from many different viewpoints. One of these is, naturally, ethnic identity.

In recent years however, a rather significant development has come to light in that many more people than ever are in search of some evidence that will link them with a Native American ancestry. Going even further, a large proportion of these are trying to establish a blood link with one or other historic Native American tribe.

 At first, this had experts baffled but gradually the truth became apparent for this unusual behaviour. One single fact made it crystal clear what the intentions of such people really were. Native Americans, otherwise known to the rest of the world as American Indians have the lawful right to host and operate gaming resorts or gambling establishments on their home territories, or reservations.

Herein lay one of the truly great ironies in the legislature and constitution of America in all their history. Article I of the US Constitution states: "Congress has the power to regulate commerce of Foreign Nations and with Indian Tribes." It is because despite their status as sovereign entities, Native Americans continue to fall under the jurisdiction of federal government when it comes to commerce.

By unearthing a lucrative loophole in the federal laws determining gambling by utilising the limitations of their reservations which do not fall under local or state authority jurisdictions, Native Americans have discovered that they are exempt from paying local, state and federal taxes. This has resulted in allowing them to carry out gambling on their reservations and pocketing the tax difference as pure profit. 

What’s more, this tax-free jamboree that gambling generates not only raises the reservation’s financial position considerable, but the Native Americans are not obliged to report their income. Each reservation’s gambling profits can only be estimated as anywhere between $10 million and several $billions, leading to a certain level of controversy and embarrassment for the federal government.

When all is said and done, gambling is therefore bigger than big business for the Native Americans and some of their reservation hosed casinos are among the most profitable in the world. They fund many spin off trades such as hotels, bars, restaurants and stores, with all revenue retained within the reservation community. A very good reason more and more people want to be Native Americans.
